Terms and Conditions of Service for Heron Energy
The following outlines the terms and conditions of service provided by Heron Energy which become effective upon utilisation of our services.
Please read these terms carefully before using Heron Energy’s services, as your use signifies acceptance of these terms. If you have any questions, please contact our Customer Services team via our website.
-
These terms govern the use of the services Heron Energy provides to its customers. By using our services, you confirm that you have read, understood, and agreed to these terms and conditions.
-
Heron Energy provides price comparison and switching services for utilities, including but not limited to energy, telecoms, waste management, water, and card machine services, to businesses in the UK. To use our services, you must:
Be a business based in the UK.
Be at least 18 years old (if operating as a sole trader).
Meet the credit requirements of relevant utility providers (if applicable)
Heron Energy reserves the right to decline services to any customer at our discretion.
-
When you choose to use Heron Energy, we will use reasonable efforts to identify, negotiate, and secure competitive pricing for the utilities we support. Prices and terms are sourced from a network of suppliers and based on the information provided by the customer. It is your responsibility to ensure that the information you provide is accurate.
The customer agrees to provide accurate and up-to-date details, including estimated or actual usage, contract end dates, and any other relevant factors that may affect pricing and quotations. Quotes provided by Heron Energy are not offers but are subject to the terms and conditions of individual suppliers. If a contract is entered into between you and a supplier, the agreement is binding, and cancellation will not be permitted unless explicitly permitted under the supplier’s terms.
Heron Energy will facilitate the contract and switching process between you and the supplier but does not guarantee that the transfer will be successful due to factors outside our control.
-
Heron Energy provides guidance on prices, suppliers, and contract terms based on market analysis and supplier data. However, market conditions can fluctuate, and while we strive to secure competitive rates, we cannot guarantee that any quote will remain the cheapest available.
Customers are responsible for validating the accuracy of all quotes and for making their own decisions regarding suppliers, contract lengths, and product types. It is also the customer’s responsibility to ensure that the agreed contracts are submitted and activated.
By using Heron Energy’s services, you acknowledge that:
Any contracts are formed directly between you and the supplier.
Heron Energy is not liable for the actions, services, or terms of any supplier.
Heron Energy acts as an independent broker and not as your representative or agent.
-
Non-Binding Nature of Quotes
All quotes provided by Heron Energy are complimentary and are offered without any obligation. They are intended solely for informational purposes and do not constitute a binding agreement or offer. Clients are under no obligation to accept or act upon these quotes, and Heron Energy is not bound to any terms presented therein.
Heron Energy is remunerated by commissions paid by suppliers for contracts facilitated by us. These commissions are typically included in your agreed costs. For example, if a price of 20p per KWH is secured and a 1p uplift is added, the final price would be 21p per KWH. Commissions are calculated based on usage and the length of the contract. For further information on our commission structure, please contact us directly.
Duplicate Contracts and Fees
If you enter into a contract facilitated by Heron Energy, it is legally binding. If a duplicate contract is made with another supplier, causing the initial contract to fail, Heron Energy reserves the right to charge a failed contract fee of £500 per service point plus VAT, or the total value of the commission that would have been earned—whichever is higher. This fee is in addition to any charges imposed by the supplier.
Change of Tenancy (COT)
If you move premises mid-contract, you must notify Heron Energy at least 14 days before the end of your contract. Failure to do so may result in charges to cover lost commissions. A failed contract fee of £500 per service point plus VAT may apply, adjusted for the portion of the contract fulfilled.
Failure to Go Live
If a contract fails to commence due to missing or incorrect customer information, or due to supplier issues, Heron Energy reserves the right to charge a one-off fee of £500 per service point plus VAT. Necessary information includes, but is not limited to, signed letters of authority, meter numbers, account details, and direct debit setup.
Supplier or Service Provider Failure
If your supplier ceases trading or a service provider fails to deliver, Heron Energy may charge a fee of £500 per service point plus VAT to cover lost commissions. These fees may be waived at our discretion if Heron Energy facilitates a new supplier contract.
-
If you have provided Heron Energy with delegated authority to renew your utility contracts, additional terms and conditions related to auto-renewals will apply.
-
Heron Energy is committed to finding the best possible prices for your utility needs, striving to beat initial renewal offers provided by your current supplier. Terms and conditions apply, including submission of valid documentation and usage data. This service is available to all customers regardless of business size or classification.
